01Has the developer shown you its construction license and municipal sales authorization?

Since May 2026, a presale without municipal authorization is void in Quintana Roo.

02Is there a bond or guarantee in favor of buyers or the municipality, and do you have a copy?

State law requires a completion certificate, a bond or a buyer guarantee before selling off-plan.

03Does the project appear free of issues on the state’s irregular-developments registry (SEDETUS)?

The state agency has listed over a hundred irregular developments (Riviera Maya News, Aug. 2026).

04Is your contract registered with PROFECO (registration number on the contract)?

Developers must register their standard contracts with the consumer protection agency.

05Does the contract state a fixed delivery date and penalties that apply to the developer too?

Penalties that only punish the buyer can be challenged.

06Are you paying into the developer’s or the trust bank’s account — never a personal account?

Payments to an agent’s personal account are the most common route to fraud we see.

07Is your agent licensed by the State of Quintana Roo?

Agents must hold a state license and can lose it for keeping or diverting client money.

08Do you know which bank is the trustee and that the land is in the trust?

On the coast, foreigners buy through a bank trust; a lien-free certificate shows what is really in it.

09Is construction progressing as scheduled, with no shutdown notices?

A shutdown for missing permits is usually the developer’s fault, not force majeure.

10Has less than a year passed since you first learned of a delay or problem?

PROFECO complaints and criminal complaints for fraud generally must be filed within one year.
